IMPORTANT NOTICE: PLEASE READ THESE TERMS & CONDITIONS CAREFULLY BEFORE REQUESTING YOUR FREE TRIAL.

By ticking the ‘I agree’ box when completing the free trial form, you agree to these terms and conditions which will bind you to the terms below. If you do not agree to these terms and conditions, you must not complete the free trial request form as we are unwilling to offer a free trial to you.

1. Introduction & Definitions

The terms and conditions below (“Terms & Conditions”) govern the free trial of mmunicMail offer (“free trial”) offered by mmunic Limited, a company registered in England under company number 6151369, whose registered office is Regus House, Herons Way, Chester, CH4 9QR.

Throughout these Terms & Conditions where we refer to the ‘Services’, we mean the mmunicMail email marketing platform service available at https://login.mmunic.email. Where we refer to ‘user’, ‘you’ or ‘your, we mean each registered holder of a login to your account in the mmunicMail services. When we refer to ‘Your End Users’, we mean the users, customers and personal records you store within the mmunicMail services. When we refer to ‘Personal Data’, we mean any information that can personal identify an individual.

2. Free Trial Offer

We currently offer a free trial of our Services (‘free trial’), with no obligation to continue if you are not happy with the Services. The free trial period is 30 calendar days (‘trial period’), which commences when we send you an invitation to set up your login to access the Services. We are prepared to extend the trial period at our discretion.

The free trial allows you to use up to 10,000 transactions within the trial period. A transaction is used for every email sent (including test emails and individual emails sent as part of a campaign), workflow triggered, API call made (including those made through the Services’ inbuilt features) or webhook used within the Services.

During the free trial, you will be able to access the Services on a self-service basis. Additional onboarding services may be provided at our discretion. You will be able to utilise our standard support services throughout the free trial.

The free trial will expire either at the end of the trial period or when you use 10,000 transactions, whichever is sooner.

3. Free Trial Eligibility

You shall only be eligible for the free trial if:

You are at least 18 years old and legally capable of entering into binding contracts,
Where subscribing to the free trial on behalf of a company or other corporate entity, you have the necessary authority to bind that corporate entity,
You are a new customer of the Services and have not already received a free trial of the Services in the last 24 months, and
The information you have provided us with to setup an account is true and accurate.

If any of the above statements are not true, we are unwilling to offer you a free trial and you must cease use of the Services immediately.

4. Use of Services during your Free Trial

Your use of the Services during your free trial is subject to your agreement to and abidance by the Services’ Terms of Use and Privacy Notice. You and other users of the Services may access these at any time within the Services at https://login.mmunic.email by clicking the links labelled ‘Terms of Use’ and ‘Privacy Notice’ respectively contained on each page.

You may not use the Services for any of the following:

Sending Spam emails
Harassing individuals
Sending offensive messages
Promotion anything illegal within your own country’s laws or the laws of the United Kingdom
Sending emails to third-party opt-in lists where end user consent has not been gathered
Promoting content related to bankruptcy, debt repair or debt consolidation
Promoting content related to stocks and shares trading
Promoting content related to affiliate or multi-level marketing
Promoting content related to adult personal services

You may invite additional named users to create a login and join your account to use the Services during your free trial. You are responsible for ensuring additional named users are informed of and abide the Services’ Terms of Use and Privacy Notice while using the Services.

5. Upon expiry of your free trial

Your free trial will expire either at the end of the trial period or when you use 20,000 transactions, whichever is sooner. At any time during the free trial you may also choose to end your free trial by emailing us at support@mmunic.co.uk from the email address you provided when registering for the free trial.

Upon expiry of your free trial, we will terminate your access to the Services. We will send you an email to the email address you provided when registering for the free trial inviting you to subscribe to the Services with details of applicable rates for your subscription to the Services (‘subscriber offer’). You will have 30 days in which to accept the invitation and subscriber offer. We are prepared to extend this timeframe at our discretion.

Acceptance of the invitation and subscriber offer will require you to enter into a written, binding contract with us for continued use of the Services at our quoted rates.

If you do not accept the invitation and subscriber offer within 30 days of the expiry of your free trial, at the end of the 30 days we will assume you no longer wish to use the Services and we will delete your account and all data and content contained therein permanently.

At any time during your free trial you may choose to end the trial period and begin subscribing to the Services by accepting the subscriber offer.

6. General

The free trial is non-transferable and no cash or discount alternative is on offer, and the free trial may not be used in combination in any other offer. We may modify or withdraw the free trial offer at any time and without notice.

Your use of the Services in the free trial is without warranty and you assume sole responsibility for results obtained from the use of the Services and assessment of the Services’ suitability for your use cases. We shall have no liability for any damage or losses in actual or in kind caused by your use of the Services in connection with the free trial, except to the extent required by the laws of England and Wales.

7. Governing Law and Jurisdiction

These terms and conditions and any disputes or claims arising out of or in connection with it or its subject matter or formation, including non-contractual disputes or claims, are governed by and construed in accordance with the laws of England and Wales.

You agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute or claim that arises out of these Terms and Conditions.
